1. Introduction

Welcome to NetherCloud! These Terms of Service (hereinafter: "Terms") govern the conditions for using Minecraft server hosting services provided by NetherCloud (hereinafter: "Provider", "we", "us").

By using our service, you accept the terms set forth in these Terms. If you do not agree with the terms, please do not use our services.

3. Service Description

NetherCloud provides Minecraft server hosting services, which include:

  • Dedicated Minecraft server resources (RAM, CPU, storage)
  • Pterodactyl-based server management panel access
  • Automatic backup system
  • DDoS protection
  • 24/7 server operation
  • Technical support

4. Registration and Account

Registration is required to use the service. During registration, you are required to:

  • Provide real and accurate information
  • Maintain your account security
  • Keep your password confidential
  • Take responsibility for all activities related to your account

The Provider reserves the right to delete accounts created with false information.

5. Fees and Payment

The service is subject to fees. Current prices are available on our website. Payment terms:

  • Fees are payable in advance as a monthly recurring subscription
  • Prices are in Euros (EUR)
  • Payment is processed through Stripe payment provider
  • Server will be suspended in case of failed payment
  • Server and data will be deleted after 30 days of payment delay

6. Cancellation and Refunds

Subscriptions can be cancelled at any time in your user account. Cancellation terms:

  • Cancellation takes effect at the end of the current billing period
  • No refund for already paid periods
  • Service remains available until the end of the paid period
  • 14-day withdrawal right from first purchase (per EU consumer protection rules)

7. Acceptable Use

The following is PROHIBITED when using our service:

  • Engaging in illegal activities
  • Using pirated, stolen, or illegally obtained software
  • Launching or participating in DDoS attacks
  • Sending spam or distributing malware
  • Harassing other users
  • Excessive or abusive use of server resources
  • Cryptocurrency mining
  • Reselling the service

In case of rule violations, the Provider is entitled to immediately suspend or delete the account without refund.

8. Availability and SLA

The Provider strives to ensure 99.9% availability. In case of service outage:

  • Planned maintenance will be announced 24 hours in advance
  • Unexpected outages will be resolved as quickly as possible
  • Proportional credit for extended outages

9. Data Backup

The Provider offers automatic backup system depending on the selected package. Important notes:

  • Number of backups depends on the selected package
  • It is the user's responsibility to regularly back up important data
  • The Provider does not accept liability for data loss

10. Limitation of Liability

The Provider's liability is limited to the amount of the service fee. The Provider does not accept liability for:

  • Indirect or consequential damages
  • Data loss
  • Loss of business profits
  • Damages caused by third parties
  • Force majeure events

11. Intellectual Property

The NetherCloud name, logo, and website content are the intellectual property of the Provider. Ownership of content uploaded by users remains with the user.

12. Modifications

The Provider reserves the right to modify these Terms. Users will be notified of changes by email and on the website. Continued use of the service constitutes acceptance of the modified terms.

14. Final Provisions

These Terms are governed by Hungarian law. Parties will primarily resolve disputes amicably. If unsuccessful, Hungarian courts have jurisdiction.
